Divorce

In Belgium, divorce is not an act of civil status but a legal proceedings. It has to be decided by a court (the Family Court) and it is therefore advisable to consult a lawyer to check all the issues involved in a divorce before embarking on this procedure. 

Foreigners may file for divorce in Belgium, regardless of the nationality of their spouse, under certain fairly broad conditions that must be examined before filing. The conditions to be fulfilled in order to be able to divorce in Belgium are determined by the law applicable to the situation, to be examined prior to filing the application with the help of a specialised lawyer, as divorce is not always subject to Belgian law.
